Terms of Service
Below lists our policies with our game servers. Included on this page is a
basic understanding of our company policies. We urge all our customers to keep
up to date with this page as it is your responsibility to keep up to date with
our company policies. BSHX reserves the right to alter this ToS at any time.
All references to "terms" or "ToS" strictly refers to the
Terms of Service explicitly stated on this page. Read this carefully and understand
that when you purchase a service from BSHX, you are entering a contract to agree
to abide by the Terms of Service described here. Your failure to follow the
Terms of Service forfeits your eligibility as a customer with BSHX.
A. BSHX name
Reference to "BSHX" in any capitalized or spaced out form refers
to one or more of the following: http://www.BSHX.com, www.BSHX.com, BSHX.com,
and any or all employee representatives of BSHX.com, including, but not necessarily
limited to, all server administrators, technical support staff, and sales staff.
B. User responsibility
Users are responsible for all configuration settings provided by BSHX at the
start of service. The customer must insure that his or her configurations abide
by our term of service at all times. If the user makes changes to files or configurations,
the user may be responsible for another setup charge if BSHX is forced to repair
and most likely reset server data in order to return the server to its original
state. Failure to comply with this agreement can result in termination of service.
Users are held liable for any content uploaded or created on the server under
his or her account. Users will be held completely responsible for any damages
or charges caused by content they produce. Customers are to abide by the Terms
of Service in exchange for an agreed service. This service is explained in full,
including prices on the order page (http://www.BSHX.com/order.php)
and specifications on the specific product's page within the BSHX website which the package the user
chose during the ordering process is listed.
C. BSHX responsibility
BSHX is to provide an agreed service to each customer for the duration and
specifications as indicated in the order form and ToS. It is not BSHX's responsibility
to ensure quality of service outside of those specified in the ToS, such as
low latency or server load. BSHX does not monitor individual provided services.
Servers may be rebooted periodically to ensure a continuing service. BSHX provides
no uptime guarantee. BSHX does not have a guaranteed timeline before service
is ready after being ordered.
D. Accountability
BSHX will not be held responsible for issues in third-party software that
cause problems to users. BSHX will not offer refunds or cancel user accounts
based on problems with third-party software. Users must also accept that BSHX
may go down to install new versions of third-party software. The usage of the
rcon command "quit" is solely at the risk of the account owner.
E. Usage
Normal use of customer privileges may include: signing up for one or more
accounts, paying fees, playing games on our servers, viewing the web site, changing
a map, loading configuration files, using the designated admin commands, using
FTP to designated directories, or restarting an HLTV or voice communication
service. Users who use BSHX's resources in malicious or deceiving ways may face
service cancellation without refund and/or permanent IP banning from the web
site and game servers without notice. Furthermore, BSHX may press criminal charges
to such individuals. Such offenses include, but are not limited to the following:
attempting to hack other user accounts, crashing servers intentionally, attempting
to bottleneck the server resources, hacking the server, uploading files that
not specifically permitted (e.g. plugins, illegal content, pictures), using
BSHX web space as a storage drive for illegal content, editing server files
that are not public or designated as the user's to edit, using fake information
during registration, and providing false financial information.
F. Password Protected Servers
Users who order a private, password protected server (private server) must
follow additional guidelines as set forth in this clause. Private servers may
not be shared by more than 1 organization, either official or unofficial. Users
may not loan private servers to other individuals. If at anytime a user's server
is occupied by clan members from two or more separate clans with no members
of the clan in charge of the server present, BSHX reserves the right to temporarily
deactivate the server. The private server password may not be advertised to
the general public, but may be posted to relay clan members the proper password.
Password protected game servers (private server) are designed for clan use only,
and are not intending to be used as public gaming servers. Violations of the
above rules may result in the user being fined the difference and service being
terminated without a refund.
G. Player Limits
BSHX reserves the right to inspect any game server configurations to insure
player limits are under the defined number of a particular service package.
Violations may result in cancellation without a refund.
H. Server Client Rates
BSHX reserves the right to alter server client data rates at any time.
I. Server Port Use
Unless otherwise specified, users may not alter the server ports or IP address
his or her service utilizes without first consulting BSHX. Violations may result
in cancellation without a refund.
J. Server Bots
We understand how some people enjoy running bots on there servers. However
bots do take extra server resources when the server is not in use. We do not
allow bots to run on any of our game servers we host that a user may be sharing
with other clients. If bots are found running on a user's game server without
prior permission, the user will be found in violation of our terms.
K. Unlimited Packages
Unlimited packages in this clause refers to the offered service "Unlimited
Package" or "BSHX Bargain." Unlimited Packages are bound by the
same regulations, unless otherwise specified, as any other service with the
following list of additions: (1) dedicated game servers may be private or public
at the discretion of the user, (2) max player limits on each dedicated game
server may be at any number that the user requests, (3) the dedicated game server's
client rate may be altered by the user, (4) the dedicated game server IP and
port may be altered to anything the user requests, and (5) bots may be installed.
All server settings are expected to be tested before being requested. All modifications
beyond the default settings are at the user's discretion, and BSHX will not
be held responsible. When monthly bandwidth usage for a single user exceeds
300 gigs, the additional bandwidth will be charged to the user at $2 per gig.
BSHX will not provide support unrelated to game servers for the Unlimited Package.
BSHX may charge users $5 per request batch if a user is judged to be excessively
requesting server setting changes, updates, or upgrades. All accounts are billed
for the last month of service when they are activated, which is pre-paid as
a setup fee in 2Checkout.com's item description. Users that fail to pay a service
bill six (6) days before a given billing cycle date automatically face service
cancellation. Upon cancellation, the user will enter their last month of service
with BSHX, which will incur the user no further charges.
L. Payment
Payments must be made via 2Checkout.com, a third party credit card processing
company to ensure security and fraud detection. Payment cycles begin the day
the order is processed and repeated on the same day each month thereafter. All
monthly payment thereafter must be received one week prior to each month's billing
cycle starting date. Customers are billed monthly until BSHX receives notice
of cancellation. If BSHX fails to receive payment by a given billing cycle date,
the user forfeits all existing data under their account and is assumed to have
submitted a formal cancellation of service with BSHX. If payment is processed
after this date, the user is responsible for all applicable setup charges.
M. Money back policies
All processed orders are final. All setup fees are final. BSHX OFFERS NO REFUNDS.
N. Cancellation Procedure
Users may request cancellation before an order is fully processed. All order
cancellation requests may be done via e-mail (sales@BSHX.com) with the subject
line (no brackets): "CANCEL [YOUR FULL NAME]" and
explain in the body of the e-mail the reason for canceling an UNPROCESSED order
and what package is being cancelled. Such emails MUST originate from the account
that the user specified during the pre-order. This type of cancellation is only
applicable if payment was sent, but not yet processed. All other types of cancellation
will go into affect after the current billing cycle. Normal cancellation may
be done by email (sales@BSHX.com) in the same fashion, but will not include
any refund of already processed funds.
O. Termination of Service
BSHX reserves the right to deny service to any users who cause an undue burden,
in any form, to our resources or customers. BSHX is the sole arbiter in deciding
if a user is an "undue burden." Customers that are terminated due
to breach of terms will not receive a refund. Customers that are terminated
by BSHX for reasons unspecified in these terms may be eligible for a refunded
of the remainder of the billing cycle. SERVICE WILL BE TERMINATED ON THE FIRST
DAY OF A NEW BILLING CYCLE IF PAYMENT IS NOT RECIEVED BY THAT DAY.
P. Financial contract
Please note that all financial contracts with BSHX are monthly. BSHX may refuse
to renew contracts at its discretion. Contracts may be altered by BSHX during
the renewal process. User may decline renewal of altered contracts. A financial
contract between the user and BSHX is created at the time an order is processed;
it's guidelines are set forth in the ToS.
Q. Prices are subject to change
BSHX prices are subject to change with little or no notice at anytime. The
current official published price is always the price listed on the web site.
Please note that in the event that a price is mistyped, a user's order may be
rejected. If the current official price is more or less than 10% of what a user
currently pay, BSHX reserves the right to alter the contract as stated in section
P. Users will be properly informed before such an increase occurs.
R. Changing service plans
Changing service plans may be done by personal request via e-mail (sales@BSHX.com).
A BSHX customer representative will verify all changes via e-mail or phone.
There is a $5 processing fee for changing service plans. Changes take place
the following billing cycle unless the user pays the difference for the current
billing cycle.
S. Upgrades & Extra Patches:
BSHX may patch a dedicated game server as needed at no charge to the user.
Dedicated game servers are setup with the base install according to the game
type ordered. Mods and add-ons may have an additional cost. Inquiries must be
made privately by email (sales@BSHX.com).
T. Failure to Comply
Failure to comply with all current and future Terms of Service Agreements
can result in termination of a user's account and/or server downtime. We will
immediately shutdown a server if we find a user's server in violation of our
terms, until the account holder insures us his/her game server does comply to
our terms. If a user has excessive violations then his account may be terminated
with no refunds. Users with "BSHX Bargains" or "Unlimited Packages"
that are terminated due to a failure to comply with the Terms of Service will
forfeit the last month of service.
U. Liability
BSHX is not liable for any data on its servers that was modified or created
by the user. The user understands he or she is responsible for all data on his
or her server and claims responsibility in the event that the user's data is
associated to illegal or damaging activity. BSHX is in no way obligated to protect,
distribute, modify, copy, backup, restore, recreate, or present any data
on its servers.
